Abstract:

The change in the legal framework for sanitation (Law 14,026, of July 15, 2020) started to require bidding in Brazil, even in cases that sanitation service was delegated by municipalities to state companies, previously carried out under a program contract. The objective was identify the actors who benefitedthe change in law and to observe the social effectiveness of privatization process, which took place in April 2021 with the auction of water supply and sewage services provided by Companhia Estadual de Águas e Esgotos do Rio de Janeiro – CEDAE in 35 municipalities in the state. An exploratory analysis of secondary data and the systemic integration methodology was adopted, which makes it possible to identify the performance of social actors in the concession of services operated by CEDAE in the state of Rio de Janeiro. It concluded that the federal, state, municipal governments, the National Bank for Economic and Social Development and private groups gainedthe concessions, but regarding the social effectiveness of the services, it was observed that is lower the proportion of low-income population served with sewage removal networks in the municipalities of the state operated by the private sector and the rates charged are, on average, higher when compared the municipalities that participated in the auction.
