Abstract:

HIV exceptionalism refers to the fact that this health condition is considered so differentthe others, that it´s testing demands a special approach considering consent. Often, HIV infected patients seek care, mainlyemergency departments, years before the diagnosis, without being tested on these opportunities. Because emergency departments are a sensitive environment, which main mission is the care of acute conditions, there are questionings regarding the appropriateness of implementing HIV screening programs. Then, “Human Rights in Patient Care” constitute an essential theoretical reference to analysis of ethical conflicts in clinical encounter leading to the strengthening of effective application of human rights principles to the context of patient care,
