Abstract:

This paper presents the main institutional changes in labor relations in Brazil, pointing to their impact effect on the organization of workers. In our days, a central change is the regulation of subcontracting by Labor Justice. Research of demands in the Superior Labor Court, orientations of the Public Labor Prosecutors Office, and trade unions actions, shows that subcontracting and working hours are subjects which have affected the health workers. By means of an approach about the institutional basis of justice in the contracts, we conclude that the labor reform must deal with the inequality of rights which have characterized the Brazilian labor market.
