Abstract:
AbstractBrazilian legislation establishes that the federative allocation of financial resources should be based on the search for regional equity to overcome social inequalities. The objective of this study is the documentary analysis of the criteria for allocation of financial resources of the SUS. Methodology: The 13 legislative and infralegislative frameworks, published between 1988 and 2023, available in three official databases, were used. Results: Intra-textual incoherence and inter-textual disarticulations were found that impact the calculation of the values for decentralized financing of the SUS. Conclusions: In the period studied, the apportionment of resources did not meet the criteria defined in the constitutional and infra-constitutional provisions. Once the legal criteria were ed, the infralegal norms were normative substitutes for calculating the amount to be decentralized, mainly in the form of incentives.
