Resumo:
El objetivo de este estudio es cuestionar el hecho de que en algunos países de América Latina (Chile, El Salvador, Nicaragua, Honduras y República Dominicana) el aborto todavía está prohibido en todos los casos. Aun cuando han corrido ríos de tinta en relación con este tema, lo cierto es que pocas veces se utiliza la teoría de los derechos humanos para su defensa. Ello seguramente se relaciona con la creencia generalizada, aunque velada, de que las mujeres embarazadas pierden, debido a su condición, sus plenos derechos humanos debiendo ceder e incluso renunciar a su vida en favor del nasciturus. Este artículo pretende demostrar que una lectura adecuada de la teoría de los derechos humanos debe incluir el derecho al aborto durante los dos primeros trimestres del embarazo, sobre la base de que las libertades fundamentales sólo pueden limitarse por el bien de la libertad misma. También tiene la intención de responder a quienes sostienen que el tema del aborto no puede ser resuelto ya que el punto exacto en el desarrollo embrionario que separa el aborto legítimo del ilegítimo no puede ser determinado. Existen argumentos morales y científicos potentes para reducir la incertidumbre y sentar las bases para reformas penales que se centren en la importancia moral de los plazos.

Abstract:
The objective of this studio is to question the fact that in some countries in Latin America (Chile, El Salvador, Nicaragua, Honduras and Dominican Republic) abortion is still forbidden in all cases. While rivers of ink have flowed about it, human rights theory is not often summoned to the defense of abortion. This ostensible slip can be traced to the pervasive, albeit veiled belief that pregnant women are inherently devoid of human rights, as their condition requires ceding and even surrendering their rights to someone else. This article intends to show that an adequate reading of general human rights theory should include abortion rights through the first two trimesters of pregnancy, noting that basic liberties can only be limited for the sake of liberty itself. It also intends to respond to those who claim that the abortion issue cannot be resolved, since the exact point in embryonic development that separates legitimate and illegitimate abortion cannot be determined. Potent moral arguments exist for an approach capable of reducing uncertainty and establishing a basis for reforms that move past prescriptive laws and focus on the moral importance of trimester laws.
